THE RESPECT FOR FUNDAMENTAL HUMAN RIGHTS AND FREEDOMS DURING THE PANDEMIC

Abstract:
2020 was a challenge for the entire society, which is facing an unprecedented sanitary crisis. This affected all the sectors of social life, including the law-making process. All the states had to adapt their legislative framework to the new social realities, and legislative acts were adopted on a national level that would regulate this unprecedented situation and establish proper social conduct. Against this background, the social reality, the sanitary crisis and the response of authorities resulted in legislative changes or in the adoption of new legal regulations that generated controversies not only in the legal environment, but in the entire society. This study aims at analysing how the constitutional principles were observed within the procedures for adopting legislative acts and how were the citizens’ fundamental rights and freedoms affected, since the restriction of such rights and freedoms must be an exception and it should not affect law itself.
